It is not genetically possible to get a sable out of a tri and a blue merle. I think the breeder may have been less than honest with you.

The tri had a sable mom and a tri colored dad and some of the pups when she was born were sable and tris and she came out a tri and the dad is just blue so in this litter of pups when i went out to get one, there was a blue merle, a tri that had passed away when it was born and sable that i had picked out at first.

Sable is dominant to tri. A tri dog cannot carry sable. It could have been possible that the dam was a tri-factored sable, a very dark one that appeared more black than sable. In which case, the breeder was just very ignorant in calling her a tri.

The genetic heirarchy goes:
ay (sable) > aw (wolf sable, not in Shelties) > at (tri) > a (recessive black)

A sable dog (ay) can carry sable, tri, or bi-black.
A tri dog (at) can carry tri, or bi-black.
And a bi-black dog can only carry bi-black.

A tri dog cannot pass on sable. The only way that there could have been sable pups in the litter is if the dam were a very dark sable, and the breeder incorrectly called her a tri.

As for the sire, being "blue", he could either have been a blue merle (tri color with merle) or a bi-blue (bi-black with merle). In either case, he cannot pass on sable either.

Why don't you want her? :confused2:You obviously wanted a pup. If you are not satisfied with this pup either than I would return her to the breeder also. Genetic defects are usually covered under a reputable breeder. :confused2: For either another pup or refund. I would be leary to adopt her because of the heart defect in the other pup you had originally and then you said another of the pups had died as well. Sounds like improper breeding or not enough reference to check for good genetics of both sire and Dame.:uhoh:
